Messa & Associates, P.C. Win Justice for Barbara Daquilante

  • Barbara was walking her normal route to work with her husband in the early morning hours of August 20, 2012.

  • Part of her route was through a dimly-lit parking lot that saw high pedestrian and vehicular travel through the day and night.

  • As she was walking, Barbara was struck at an angle by a multi-ton garbage truck and dragged for a significant distance, de-gloving the skin and tissue from her leg.

  • Her husband, Carmen, who was across the street, heard her screams and hollered to the truck driver to stop. The driver did not hear Carmen and continued on, Barbara underneath.

  • Barbara underwent a total of 12 surgeries related to her extensive lower extremity injuries and still continues to receive regular medical treatment today.

  • Joe Messa and Jenimae Almquist of Messa & Associates proved that Barbara’s injuries were caused by the defendant driver’s negligence and the unsafe design and defective/inadequate lighting of the parking lot. Barbara and her husband Carmen were awarded a $5.2 Million settlement.
